Magic mushrooms are illegal in the Netherlands, the United Kingdom, Germany and under US federal law. Fresh magic truffles are the exception: in the Netherlands they fall outside the Opium Act and are sold openly to adults. The terms below explain the wording behind those rules, so that you can read a law text or a news report without guessing.
Status checked on 14 October 2026 against the sources linked in each entry. This is general information, not legal advice. Laws change, and the law of the country you are in always applies, including to anything you carry across a border.
The Netherlands
Opium Act

The Dutch drug law (Opiumwet), with two lists of controlled substances. The version checked here has been in force since 17 September 2026 (wetten.overheid.nl). Mushrooms that contain psilocin or psilocybin are prohibited, sclerotia are not mentioned, and according to DRUGSinfo grow kits are legal to sell and own.
List I

The list usually called the hard drugs list. Psilocine and psilocybine are on it as pure compounds, next to drugs such as LSD and MDMA. Jellinek, the Amsterdam addiction care organisation, writes that dried mushrooms and dried truffles fall under List I (Jellinek).
List II

The second list of the Opium Act. Its entry for paddos covers "paddenstoelen die van nature de stof psilocine of psilocybine bevatten" (mushrooms that naturally contain psilocin or psilocybin) and names more than 200 species. Fresh mushrooms have been prohibited since December 2008; selling and possessing dried ones was prohibited before that (DRUGSinfo).
Fresh and dried

A distinction that matters twice in Dutch law. Before December 2008, fresh mushrooms were sold openly while dried ones were already prohibited. Today all paddos are prohibited, while truffles are sold fresh. Fresh truffles are the legal product; Jellinek places dried truffles under List I.
Smartshop
3 cross-referencesShow on the map
A Dutch shop that sells legal psychoactive products such as fresh truffles, alongside herbs, test kits and grow supplies. DRUGSinfo states that truffles are legal "omdat het geen paddenstoelen zijn" (because they are not mushrooms). Dutch-Smart, which publishes this site, is one of them.
Truffle ruling
3 cross-referencesShow on the map
The judgment of the Dutch Supreme Court (Hoge Raad) of 10 April 2026, ECLI:NL:HR:2026:450, in a VAT case about a truffle seller. The court starts from the position that "magische truffels vallen niet onder de Opiumwet zodat zij vrij kunnen worden gekweekt en verhandeld" (magic truffles do not fall under the Opium Act, so they may be grown and traded freely). It rejected the seller's claim to the reduced VAT rate for food (rechtspraak.nl).
Driving under the influence

Article 8 of the Dutch Road Traffic Act 1994 prohibits driving under the influence of a substance that you know, or should reasonably know, can reduce your ability to drive (wetten.overheid.nl). That covers truffles. DRUGSinfo adds that a user is not yet sober when the main effects have passed.
Age limit

Dutch-Smart sells truffles and related products only to adults, 18 and over. This site is written for adults as well.
Other countries
Class A

The most serious category of the UK Misuse of Drugs Act 1971. The Drugs Act 2005 added "Fungus (of any kind) which contains psilocin or an ester of psilocin" to it (legislation.gov.uk). Psilocybin is an ester of psilocin, so fresh and dried mushrooms are covered, and on the plain wording sclerotia are too. Truffles bought in the Netherlands should be regarded as illegal in the UK.
Annex I

Anlage I of the German Narcotics Act (BtMG) lists the substances that may not be traded or prescribed. Psilocybin and psilocin are on it, together with a clause that covers organisms and biological materials suited to producing such substances when abuse for intoxication is intended (gesetze-im-internet.de). Psilocybin mushrooms and truffles are controlled in Germany.
Schedule I

The strictest category of the US Controlled Substances Act. Psilocybin (drug code 7437) and psilocyn (7438) are listed among the hallucinogenic substances in 21 CFR 1308.11 (Cornell LII). States and cities have their own rules on top of federal law and change them regularly; this glossary does not track them one by one.
Decriminalisation
2 cross-referencesShow on the map
Reducing a criminal offence to a lesser one, such as a fine, while the substance stays illegal. Legalisation goes further and makes possession or sale lawful under conditions. Oregon is the clearest recent example: Measure 110 made possession of small amounts of drugs such as heroin, LSD and methamphetamine a civil violation from 1 February 2021, and House Bill 4002 made it a criminal misdemeanour again from 1 September 2024 (Wikipedia).
